Heard the counsel for petitioner, and Sri N. Siva Reddy, counsel for respondents.

The petitioner has filed the present Writ Petition assailing Memo dt.01.11.2018 placing him under suspension on the ground that a criminal case in Crime No.226 / 2018 was registered against him under Sections 498-A, 323, 506 of I.P.C.; that he was arrested on 18.08.2018 and had not reported to duties even after his expiry of Medical Leave on 31.08.2018; that he was detained in judicial custody for more than (48) hours; that the charge against him is one involving moral turpitude; and it is therefore, necessary to place him under suspension, pending disciplinary action.

This order has been passed invoking Regulation-11 of the Andhra Pradesh State Electricity Board Discipline and Appeal Regulations, adopted by the 1st respondent.

It is not the case of petitioner that when an employee is involved in a criminal case and has also been detained in judicial custody for more than (48) hours, the employer is not entitled to take any action.

Since admittedly Regulation-11 permits the same, I do not find any merit in the Writ Petition and it is accordingly dismissed at the stage of admission. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
