HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.42396 OF 2017 O R D E R :
The case of the petitioner is that she preferred appeal before the 2nd respondent on 31.07.2017 against the order dated 22.07.2017 passed by the 3rd respondent cancelling the fair price shop authorisation of the petitioner. As no orders are passed in the said appeal, present writ petition is filed.
Heard learned counsel for the petitioner who submits that though explanation is filed, the same is not considered in proper perspective and no enquiry is envisaged under A.P.State Public Distribution System (Control) Order, 2008 (for short 'Control Order').
Heard learned Assistant Government Pleader for Civil Supplies who submits that because of variations, after issuing notice, petitioner's fair price shop authorisation was cancelled.
A reading of the show cause notice does not indicate which clause of the Control Order is violated by the petitioner. When statutory appeal is pending before the 2nd respondent, it is for the 2nd respondent to dispose of the said appeal.
In view of the above, the writ petition is disposed of directing 2nd respondent to dispose of the appeal filed by the petitioner within a period of three months from the date of receipt of a copy of this order. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending shall stand closed.
