HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.45004 of 2018 ORDER:

The grievance of the petitioner was that the Superintending Engineer, Irrigation Circle, Khammam, evaluated its bid as nonresponsive in relation to the tender notifications bearing NIT Nos.42/2018-19 dated 11.9.2018 and 44/2018-19 dated 11.9.2018 pertaining to construction of check dams across Kinnerasani river near Suraram (Rangapuram) and Pandurangapuram Villages in Palvoncha Mandal, Bhadradri Kothagudem District. While so, the learned Assistant Government Pleader for Irrigation and Command Area Development, State of Telangana, would inform this Court that by proceedings dated 05.01.2019, the tender notifications in question were cancelled by the Superintending Engineer. A copy of the said proceeding is placed on record and perusal thereof reflects that the cancellation was due to the fact that the bid validity period in relation to the subject tenders expired on 30.12.2018.

In the light of the aforestated development, the cause in the Writ Petition does not survive for independent consideration on merits. The Writ Petition is accordingly dismissed on this short ground leaving it open to the petitioner to work out its remedies in accordance with law if it is aggrieved by the cancellation of the tender notifications vide the proceedings dated 05.01.2019.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
