HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.43965 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the affidavit filed in support of the above Writ Petition, the petitioner prayed that this Hon'ble Court may be pleased to issue a Writ, Order or Direction, more particularly one in the nature of 'Writ of Mandamus' declare the action of the respondents particularly R4 in issuing a press note dt: 6-12-2017 arranging all the pilgrims to book all seva tickets on online without issuing any notice to petitioner as his tender period is subsisting till 31-3-2018 as illegal, irregular, highhanded, in-violation of principles of natural justice, in-violation of Art.
16 and 21 and also the tender rules by issuing a Writ of Mandamus or any other appropriate Writ and consequently direct the respondents to receive the tickets, letter pads, books and all Athi Seegra Dharshanam, Nijarupa Darshanam, Pratyeka Darshanam, Laddu Tickets and continue petitioner tender till 31-3-2018, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard Smt K.N.Vijaya Lakshmi, learned counsel appearing for the petitioner and the learned Government Pleader for Endowments appearing for the respondents 1 to 4. Perused the material available on record.

The case of the petitioner is that it was awarded a contract for printing Athi Seegra Dharshanam, Nijarupa Darshanam, Pratyeka Darshanam, Laddu Tickets, letter pads, Vibhudi covers, daily collection register, voucher books, etc. and the tender was granted for a period of one year i.e., from 01.04.2017 to 31.03.2018. The main grievance of the petitioner is that the 4th respondent issued a press note, dated 06.12.2017,
introducing service through computer and also published the press note, dated 06.12.2017, informing the general public that hereafter, if anybody wants to visit Kanipakam Temple, they have to purchase Arjitha Seva and Darshanam tickets online only. Aggrieved by the same, the present writ petition is filed by the petitioner.

Learned counsel for the petitioner submits that the petitioner was not even informed by way of notice that the Devasthanam arranged online booking for all Seva Tickets. According to him, the petitioner has already printed books, Darshanam tickets and all Arjitha Seva Tickets, etc., as per the work order, dated 06.12.2017, by spending money and that the tender period is in subsistence till 31.03.2018, but however, the 4th respondent, without issuing any notice, in writing, high-handedly published the press note, dated 06.12.2017, permitting the Pilgrims to book all seva tickets online, by which action, the pilgrims are not purchasing the books, tickets, etc., already printed from the petitioner and not even allowing the petitioner to supply the same.

Considering the facts and circumstances of the case and the submissions of the learned counsel for the petitioner, this Court is of the considered view that the Press Note, dated 06.12.2017, has nothing to do with the contract awarded in favour of the petitioner, which is in subsistence till 31.03.2018, whereunder, the petitioner was given contract to print the Seva Tickets and Darshanam tickets and all Arjitha Seva Tickets and also Laddu token tickets. However, considering the apprehension
of the petitioner, it is directed that as long as the contract awarded to the petitioner is subsisting, it is entitled to supply the quantity of books, tickets, etc., entrusted to it under the contract. 6.
Subject to the above observations, the Writ Petition is disposed of.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
There shall be no order as to costs.
