M/S. Sai Maruthi Enterprises, v. The State Of Telangana

The Hon'ble Sri Justice A.Rajasheker Reddy Writ Petition No.41830 of 2017 Order:

This Writ Petition is filed for the following substantive relief:

"to issue a writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the Proceedings No. D1/738/2017 dated 11-7-2017 passed by the Respondent No.4 and consequential Appellate Authority proceedings No. in SR cell (2) 449/2017, dt.1810-2017, in so far as the 1st petitioner is concerned, passed by the 2nd Respondent herein, Proceedings No. D1/738/2017 , dt.11-07-2017, and consequential Appellate Authority Proceedings No. in SR cell (2) 465/2017 dt.1810-2017 in so far as the 2nd petitioner is concerned passed by the 2'd Respondent and proceedings No. D1/738/2017, dt.11-07-2017 and consequential Appellate Authority Proceedings No. in SR cell ( 2) 447/Nlg/2017, dt.

18-102017, in so far as the 3rd petitioner is concerned, of the 2nd Respondent, canceling the Petitioner's Seed Licenses and confirmed the orders as illegal, arbitrary and contrary to the Circular instructions issued by the Respondents are time to time and also the Seeds Act, 1966 and violative of Articles 14 and 21 of the Constitution of India, and consequently direct the Respondents to restore the Seed Licences of the petitioners forthwith."

At the hearing, it is conceded by learned Counsel for both parties that the issue raised in this Writ Petition is

ARR, J W.P.No.41830 of 2017 Dt: 11-12-2017 similar to that raised in WP.No.38554 of 2017, which was allowed in respect of petitioner No.1 therein, by this Court vide Order, dated 27-11-2017.

Following the same, this Writ Petition is also allowed in terms thereof with the direction that the reasons and directions contained therein shall form part of this order. As a sequel, Miscellaneous Petitions, pending if any, stand disposed of as infructuous.
