THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.41787 of 2017 ORDER:
The petitioner is stated to be working as Sub Inspector of Police, Special Branch, S.P.Office, Wanaparthy, and now he is eligible for consideration of his case for promotion to the post of Inspector of Police (Civil). Since he was involved in an offence under Sections 448, 506, 186 read with 34 IPC, departmental proceedings were initiated against him and they are pending. Though initially he was kept under suspension, his suspension was later revoked and now he is working as Sub Inspector of Police at Wanaparthy. In view of the pendency of the departmental proceedings, when the case of the petitioner was not considered for promotion, he filed the present Writ Petition.
In similar matters, this Court noticed that there is no rule prohibiting consideration of the case of the persons like the petitioner for promotion when departmental proceedings are pending, and granted directions to consider their cases. In the circumstances, this Writ Petition is also disposed of directing the respondents to consider the case of the petitioner for promotion along with others, if there is no rule prohibiting consideration of the case of the petitioner in the facts and circumstances of the case and if he is otherwise eligible.
