HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.7358 of 2017 ORDER:

Heard learned counsel for the petitioner before admission and before notice to the revision respondent/defendant and perused the impugned order, dated 20.11.2017, in I.A.No.608 of 2017 in O.S.No.93 of 2016 of the I Additional District Judge, Ongole, and grounds of revision.

Though not specifically pleaded, in the course of hearing, it is one of the submissions by the learned counsel for the revision petitioner that the Court can take it as an application for appointment of a receiver. Though it is the settled law, as pointed out of mere wrong quoting of a provision is not fatal, here, there is no prayer for appointment of receiver even to consider the application as one under Order 40 C.P.C., but for giving liberty if any to file such application before the lower Court.

Having regard to the above, there is nothing to admit and keep the matter pending, but for to direct the trial Court to dispose of the suit subject to other preferences, preferably within six months from the date of receipt of a copy of this order.

Accordingly and in the result, the civil revision petition is disposed of.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
