THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Criminal Petition No.12372 of 2017 ORDER:

Precisely, the request in the present Criminal Petition, which is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code'), is to direct the learned Magistrate to dispose of the case as early as possible on the premise that the petitioner is bedridden and old aged, as argued by the learned counsel Sri Janardhana Reddy Ponaka.

The learned counsel also pointed out that the provisions of Section 143 of the Negotiable Instruments Act, 1881, mandating that the procedure shall be resorted as if it is a Summary Trial Case. The proceeding sheet maintained by the learned Magistrate filed would show that for the past three consecutive adjournments the complainant did not attend and was called absent. 3.

As could be seen from the proceeding sheet, the accused has also not presented himself.

Keeping in view, the condition of the petitioner, the learned Magistrate is directed to dispose of the Calendar Case No.186 of 2015 on his file as expeditiously as possible preferably not later than one year from the date of receipt of a copy of the order. 5.

The present Criminal Petition is accordingly disposed of to the extent indicated in the above.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition shall stand closed.
