The petitioner challenging the notice dated 25-10-2017, wherein the petitioner was directed to produce bank guarantee for releasing of the seized vehicle belonging to the petitioner. Learned counsel for the petitioner submits that though it is termed as notice, it is in the form of order and valuation of the vehicle is not ascertained even as per panchanama and violation in respect of PDS rice is only Rs.88,000/-. Heard learned Assistant Government Pleader for Civil Supplies.

Valuation of the vehicle shall be taken into account for release of the vehicle, but no particulars are mentioned in the order.

In view of the same, the impugned order is set aside. The 2nd respondent is directed to consider release of the vehicle in favour of the petitioner on furnishing security to the value of the seized vehicle only.
