This petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.2 in Crime No.241 of 2017 on the file of Prohibition and Excise Station, Piler, Chittoor District. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, A1 is alleged to have been purchasing liquor from the shop of this accused, who is a licence holder, for the purpose of selling the same for higher prices.

Hence, from the facts of the case, this court opines that this is not a fit case for granting anticipatory bail. However, the petitioner can obtain regular bail by surrendering himself before the police.

Considering the plea of the petitioner that he may be safeguarded from arrest, the Police are directed to follow the guidelines enunciated by the Supreme Court in Ar n esh Ku m ar v. St at e of Bih ar an d an ot h er ( Cr l.Appeal No.1 2 7 7 of 2 0 1 4 ) 1, before effecting the arrest of petitioner. The Criminal Petition is accordingly dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
