Heard the learned counsel for the petitioner and learned Public Prosecutor representing the 1st respondent/ State before admission and before notice to respondents 2 and 3. 2.

The petitioner is respondent in M.C.No.18 of 2015 filed by respondents 2 and 3 herein on the file of the Judicial Magistrate of First Class, Kotabommali.

The learned Magistrate issued NBW for the absence of the petitioner herein by dismissing the application in Crl.MP.No.203 of 2018 on 10.10.2018, which was filed to condone his absence under Section 317 Cr.P.C, is set aside by recalling the warrant. However, the petitioner as respondent to M.C. proceedings shall appear before the learned Judicial Magistrate of First Class, Kotabommali, on 27.12.2018 without fail and participate in the proceedings for recovery of the maintenance amount pending against him, without fail.

Accordingly, the Criminal Petition is disposed of. 5.

Consequently, miscellaneous petitions, if any shall stand closed.
