THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.39634 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue Writ, order or orders specially one in the nature of Writ of Mandamus declaring the action of the 4th respondent in passing of the order in Rc.No.331/2017-19/A4 dated 18-11-2017 as illegal, arbitrary, violative of principles of natural justice, contrary to A.P.Excise Act, 1968 and the rules made there under and also offends Articles 14, 19 (g) of Constitution of India and consequently set aside the impugned order dt.18.11.2017 in R.C.No.331/2017-19/A4 and pass such other order or orders as are deemed fit and proper." (Reproduced verbatim) 2.

I have heard the submissions of Sri Mangena Sree Rama Rao, learned counsel appearing for the petitioner, and of the learned Government Pleader for Excise appearing for the respondents 1 to 5. I have perused the material record.

At the hearing, learned counsel appearing for the petitioner and the learned Government Pleader for Excise appearing for the respondents 1 to 5 agree that the issue involved in the present writ petition is squarely covered by the orders of this Court, dated 06.11.2017, in W.P.No.36491 of 2017 and that, therefore, this writ petition can be disposed of on same lines.

In view of the submissions and the earlier orders of this Court and for the reasons alike as were mentioned in the earlier orders of this Court in the afore-stated writ petition, this Writ Petition is also disposed of in terms thereof.

Office is directed to enclose a copy of the order, dated 06.11.2017, passed in W.P.No.36491 of 2017 to this order.

MSRM, J W.P.No.39634 of 2017 There shall be no order as to costs.
