This Court made the following :

ORDER:

Heard learned counsel for petitioner, learned Government Pleader for Energy, for 1st respondent, and Sri M.Ravindra, learned Standing Counsel, for respondent Nos.2 to 5.

The petitioner claims to be the owner and possessor of the building consisting of ground, first and second floors bearing D.No.130/1, near bridge, Epuru, Pedapadu Mandal and West Godavari District. The petitioner was sanctioned electricity power supply connection bearing Nos.1512083301 002844 and 1512083301 002842. Alleging that without notice and proper intimation, the power supply connection of the petitioner in the ground and first floors of the building bearing aforestated Service Connection numbers were disconnected in November, 2018, this Writ Petition is filed.

This Court, by order dated 12.12.2018, directed for restoration of power supply, if the power supply was disconnected without prior notice or opportunity.

Learned Standing Counsel produced a letter of the Additional Assistant Engineer, dated 17.12.2018, informing him that the power supply to the Service Connection bearing Nos.1512083301 002844 and 1512083301 002842 is restored. Further, learned Standing Counsel, on instructions, fairly submits that a prior notice was not issued before taking coercive action against the petitioner.

The Writ Petition is allowed holding the action of disconnection, without following due process, as illegal and respondents are directed not

to disconnect the power supply, without following the due process. In consequence, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs.
