This Criminal Petition is filed seeking for grant of bail to the petitioner, who is Accused No.2 in Crime No.934 of 2017 on the file of Mailardevpally Police Station, Cyberabad.

The offences alleged are under Sections 307 R/w.34 I.P.C. and Section 25(1)(A) of the Arms Act, 1959, and Section 307 I.P.C. is subsequently altered to Section 302 I.P.C.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.
Learned counsel for the petitioner submits that the petitioner has been in jail since 25.10.2017 and that Accused No.3, who is on the same footing as that of this petitioner, was enlarged on bail on 20.12.2017 by the learned III Additional District Judge, Ranga Reddy District at L.B. Nagar (for short, 'the Court below'). He further submits that earlier bail application filed by the petitioner and others in Crl.P.M.P. No.4799 of 2017, was dismissed on 28.11.2017 by the Court below, on the ground that the investigation was not completed and that subsequently considering that the investigation is completed, the Court below granted bail to Accused No.3. The petitioner is on the same footing as that of Accused No.3.

Considering the above submission and also taking into consideration that the petitioner has to attend the examinations, which started from 25.12.2017 onwards, this Criminal Petition is allowed.

Accordingly, the petitioner/Accused No.2 is directed to be enlarged on bail, on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the VIII Metropolitan Magistrate, Cyberabad at Rajendranagar. Accordingly, with the above observation, the Criminal Petition is allowed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
