HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TRANSFER CIVIL MISCELLANEOUS PETITION Nos.827 and 829 of 2017 COMMON ORDER :

These petitions are filed by the petitioners/ defendants 2 and 3 under Section 24 C.P.C., to transfer O.S.Nos.292 and 319 of 2012 from the learned Senior Civil Judge, Vizianagaram, to the learned I Additional Senior Civil Judge, Visakhapatnam, to try along with O.S.No.1174 of 2016.

Heard the learned counsel for the petitioners. Though respondents are served as evident from the memo in U.S.R.Nos.8689 and 8690 of 2017, there is no appearance on their behalf.

Having heard the submissions of the learned counsel for the petitioners, this Court deems it appropriate to withdraw O.S.No.1174 of 2016 from the file of the learned I Additional Senior Civil Judge, Visakhapatnam, and transfer the same to the learned Senior Civil Judge, Vizianagaram, where O.S.Nos.292 and 319 of 2012 are pending, for simultaneous disposal.

Accordingly, the Tr.C.M.Ps. are disposed of.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. There shall be no order as to costs.
