HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.42017 OF 2017 O R D E R :

This writ petition is filed with the following relief; " ....to issue a writ, order or direction and more particularly one in the nature of writ of Mandamus declaring the action of the Respondent No.4 in not considering the objections petition file No.F/9416/2016, dated 25.05.2017 for apportionment among all the legal heirs of late Thimmanna including the respondent No.6 and others the same was received by the Respondent No.4 by the petitioners for land in Sy.No.95 to an extent of Ac.10.04 guntas, situated at Karkond Village of Nawabpet Mandal, Mahabubnagar District, as illegal, arbitrary and contrary to law and facts under the following facts and circumstances of the case and to pass such other order....."

Heard both sides.

It is to be seen that already the petitioners have filed civil suit for partition against the unofficial respondent and two others. If there is any grievance regarding payment of compensation to the unofficial respondent, it is open for the petitioners to obtain orders in the said suit. In view of the same I do not see any reason to entertain the writ petition.

Accordingly, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending shall stand closed.
