HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner claims to be involved in business of purchase of paddy from the farmers, convert the paddy into rice by way of milling in the rice mill and sell the same to the retailers. According to petitioner, after milling the paddy, 500 bags of rice weighing 250 quintals was loaded in three vehicles and during transit, when vehicles reached at the outskirts of Jookal village, the same was intercepted by the Station House Officer of Chityal Police and seized the vehicles along with stocks alleging that said rice is PDS rice. Crime No.204/2018 was registered against the petitioner. This Writ Petition is filed alleging that there is possibility of sale of rice seized. Petitioner seeks release of rice seized. Material on record would disclose that on 04.12.2018 petitioner filed petition before the Joint Collector, Jayashankar Bhupalpally district praying to release the stock of 250 quintals of rice seized. Within few days, this writ petition is filed.

Since petitioner has already filed petition before the Joint Collector praying to release the stock and the said petition is pending consideration of the Joint Collector, Court is not inclined to entertain the writ petition. Writ Petition is accordingly dismissed. However, it is needless to observe that Joint Collector shall consider the representation of petitioner and pass appropriate orders within a period of four weeks from the date of receipt of copy of this order. Until orders are passed, respondents shall not undertake conducting of open auction for sale of rice seized.
