THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39836 of 2017 ORDER:

The petitioner already filed Writ Petition No.18990 of 2016. The prayer in the said Writ Petition reads as follows: - "... the High Court may be pleaded to issue writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in interfering with the petitioner's society legitimate activities in the Petitioner's club including playing of Rummy and Bridge with stakes as illegal, arbitrary and violative of principles of natural justice and consequently, to direct the respondents not to interfere with their legitimate activities in the Petitioner's club including the playing of Rummy and Bridge with stakes."

On 15.6.2016, the following interim direction was issued:- "Notice before admission.

The learned Government Pleader for Home seeks time to get instructions.

Having regard to the facts and circumstances of the case, the respondents-Police are directed not to interfere with the activities of the petitioner's club including playing of Rummy and Bridge with Stakes.

It is needless to mention that if any action is required to be taken by the respondent-authorities with regard to the activities of the petitioners club, it would be open for them to do so in accordance with law."

It is not in dispute that the said Writ Petition is pending. By referring to the apprehension of members of petitioner-Club that there is every possibility of raiding the Club by Police, the present Writ Petition is filed.

This Court is of the view that to the extent required by law, the order dated 15.6.2016 is in operation. Filing this Writ Petition for the same relief is untenable. Hence, this Writ Petition is dismissed. Liberty is granted to the petitioner to workout the remedies in Writ Petition No.18990 of 2016. No order as to costs.

As a sequel, Miscellaneous Petitions, if any, pending, shall stand disposed of as infructuous.
