HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.42777 OF 2017 ORDER:

This writ petition is filed challenging the proceedings dated 01-11-2017, wherein and whereby the petitioner's fair price shop authorization was suspended pending enquiry. Learned counsel for the petitioner says pending enquiry under Section 6-A of the Essential Commodities Act (for short "the Act"), petitioner's fair price shop authorization cannot be suspended. He further says that petitioner's fair price shop authorization was suspended on 01-11-2017. After that, no notice is issued and no final orders are passed. Since Suspension of fair price shop authorization of the petitioner is pending enquiry but not on the basis of enquiry under Section 6-A of the Act, this Court is not inclined to interfere with the same.

In view of the same, the 2nd respondent is directed to conclude enquiry and pass final orders within a period of four weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. ______________________ A.RAJASHEKER REDDY,J 15-12-2017 Note:
