Rep. by its Public Prosecutor, High Court of Judicature, at Hyderabad for the State of Telangana and the State of Andhra Pradesh. .....Respondent/ Complainant Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the petition filed herein, the High Court may be pleased to grant anticipatory bail to the petitioner directing the Station House Officer, Bellampalli Town-II Police Station, Mancherial District to release the petitioner in the event of her arrest in connection with FIR No.10 of 2017, dated 2-2-2017 on the file of Station House Officer, Bellampalli II-Town Police Station, Mancherial District. The petition coming on for hearing, upon perusing the Petition filed in support thereof and upon hearing the arguments of Sri V. Ravi Kiran Rao, Advocate for the Petitioner/A.2 and of the learned Additional Public Prosecutor (TG) for the Respondent-State, the Court made the following ORDER:

"This Criminal Petition is filed by the petitioner/A.2 under Section 438 Cr.P.C. for grant of anticipatory bail to her in Crime No.10 of 2017 of Bellampally II Town Police Station, Adilabad District, registered for the offence punishable under Section 304 Part II I.P.C.

Heard the learned counsel for the petitioners/A.2, learned Additional Public Prosecutor representing the respondent-State, and perused the record. 3.

During the course of submissions, it is brought to the notice of this Court that the petitioner/A.2 is alleged to have been selling toddy in the subject shop. The accused No.1 is said to be the owner of the shop. The said accused No.1 was granted bail by this Court under Section 438 Cr.P.C., vide order, dated 28.11.2017, passed in Criminal Petition No.11380 of 2017.

Having regard to the nature of allegations, the petitioner/A.2 is also entitled to bail under Section 438 Cr.P.C.

Accordingly, the petitioner/A.2 is directed to surrender before the Station House Officer, Bellampally II Town Police Station, Adilabad District, within a period of 15 days from the date of this order. On such surrender, the Station House Officer, Bellampally II Town Police Station, Adilabad District, shall release the petitioner/A.2 on bail on her executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties in a like sum each to his satisfaction. On release, the petitioner/A.2 shall report before the said Station House Officer on every Sunday between 8-00 a.m. and 10-00 a.m. till filing of the charge sheet. The petitioner/A.2 shall also abide by the conditions stipulated in Section 438(2) Cr.P.C. and cooperate with the investigating officer in the investigation of the case.

This Criminal Petition is, accordingly, allowed. As a sequel, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed."
