HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.45042 of 2018 ORDER:- When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Pedda Vangara Police Station, Mahabubabad District, dated 12.12.2018, are placed on record by the learned Government Pleader. The said instructions read as under:- "One Smt.Eruru Pushpa, W/o.Srinu, Occ: Labour, resident of Peddavangara, Mahabubabad District, has approached the Police of Peddavangara and lodged a complaint on 14.08.2018 stating that her daughter by name Eduru Mounika, aged 22 years, Occup: Student, has completed B.Ed., and was staying at home and on 13.08.2018 morning herself and her husband went to attend the coolie works and in their absence, her daughter left her house around 1500 hours on 14.08.
2018 and went away and missing and requested to take necessary action as per law. Basing on the contents of the above complaint, a case in Cr.No.53/2018 under the Head of Woman Missing, dated 14.08.2018, was registered on the file of Peddavangara Police Station and investigation was taken up. During the course of investigation, this respondent being the Investigating Officer examined the complainant and some other witnesses and recorded their detailed statements. However, till date, no clues are forthcoming about the missing woman.
It came to light that the petitioner herein is the uncle of the missing woman and he knows pretty well about the whereabouts of the missing woman, for which, this respondent tried to contact the petitioner for investigation purpose, he did dnot turn up and filed the present Writ Petition.
It is submitted that the petitioner is not at all required. Except to know the whereabouts of the missing woman, this respondent tried to contact him, the petitioner rushed to this Hon'ble Court and filed the present Writ Petition. In view of the above reasons, this respondent Police are unable to trace out the missing woman. It is humbly submitted that the allegation of the petitioner that this respondent Police insisted him to come to the Police Station and harassing him is utterly false, baseless and hence denied.
In view of the non-cooperation of the petitioner who knows very well the whereabouts of the missing woman, the investigating agency is unable to proceed with further investigation into the matter."
Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Pedda Vangara Police Station, Mahabubabad District, dated 12.12.2018, with a further direction to the respondent-Police authorities to act strictly in accordance with law.
Miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs.
