Gujjala Ramu, v. The State Of Andhra Pradesh,
HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.41018 OF 2017 O R D E R :
Learned counsel for the petitioner states that the impugned order is passed without mentioning the time limit as specified under Rule 42(1) of the Rules Relating to Taxes and Lodging of Monies received by the Gram Panchayat and Payment of Monies from the Gram Panchayat Fund (for short 'the Rules). He also relied on the Judgment rendered by this Court in Somagani Venkata Subbamma v. District Panchayat Officer, Krishna District and another 1. The same is not disputed by the learned Assistant Government Pleader for Panchayat Raj.
In view of the same, the impugned order is set aside. However, this will not preclude the competent authority from passing fresh order in terms of Rule 42(1) of the Rules. Accordingly, the writ petition is allowed. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 11.12.2017 t k.
