The Hon'ble Dr.Justice Shameem Akther Criminal Petition No.11951 of 2017 Order:

This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioners/accused Nos.1 & 2, seeking anticipatory bail in the event of their arrest in connection with Crime No.38 of 2017, on the file of the Women Police Station, Anakapalle, Visakhapatnam District, registered for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Heard the learned Counsel for the petitioners, learned Additional Public Prosecutor appearing for the respondent- State and perused the record.

It is alleged that the petitioners, who are husband and mother-in-law of the de facto complainant, harassed her for additional dowry and left her in her maternal uncle's home. Having regard to the nature of allegation, it is appropriate to pass an order in terms of the directions given in Rajesh Sharma and others vs. State of U.P. and another1.

Accordingly, relying upon the latest two-Judge Bench expression of the Apex Court, dated 27-07-2017, in Crl.A.No.1265 of 2017 (SLP (Crl.) No.2013 of 2017) in Rajesh Sharma Supra, the matter is directed to be referred by the learned jurisdictional 1 2017 (2) ALT (Crl.) 393 (SC)

Dr.SA, J Crl.P.No.11951 of 2017 Dt: 12-12-2017 Magistrate to the Committee to be constituted for reconciliation and settlement and in a contra situation, to proceed with the subject matter of crime on merits. The petitioners shall not be arrested till a report is filed by the Committee.
