THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.11672 OF 2017 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against petitioner/accused in Crime No.264 of 2017 of Ramgopalpet Police Station, Secunderabad, registered for the offence punishable under Section 337 of IPC.

Heard and perused the material available on record. Specific allegations were made against the petitioner/accused in the complaint. This is a matter which requires investigation by the police. The truth or otherwise of the allegations can only be decided during course of investigation. I see no ground to interdict the investigation at this stage and quash the first information report.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the Criminal Petition is disposed of, directing the investigating agency to scrupulously follow the procedure, as envisaged under Section 41-A Cr.P.C. and as held by the Apex Court in Arnesh Kumar v. State of Bihar1 during course of investigation.

Miscellaneous petitions pending, if any, shall also stand closed.
