CRIMINAL PETITION NO. 12768 OF 2017 O R D E R :

This Criminal Petition is filed by the petitioners/A-1 to A-9 under section 438 of Cr.P.C., seeking for the grant of anticipatory bail in Crime No. 226 of 2017 of Vallur Police Station, Kadapa district, registered for the offences punishable under section 323, 506 read with section 34 of IPC and Section 3 [1] [r] [s] of Scheduled Castes and Scheduled Tribes [Prevention of Atrocities] Amendment Act, 2015.

2. Heard the counsel for the petitioners/A-1 to A-9 and the Additional Public Prosecutor representing the respondent/State.

3. The allegations against the petitioners is that they abused the defacto-complainant in his caste name, beat him with hands and legs, tried to throttle him. The nature of allegations in the complaint are very specific and attract Section 3 [1] [r] [s] of Scheduled Castes and Scheduled Tribes [Prevention of Atrocities] Amendment Act, 2015. In such

circumstances, anticipatory bail cannot be granted to the petitioners/A-1 to A-9, as Section 18 of the Act lay an embargo.

4. Hence, in view of the above, this Criminal Petition is dismissed.

5. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
