SMT JUSTICE T.RAJANI CRIMINAL PETITION Nos.13259, 13261 & 13268 OF 2018 COMMON ORDER:

These three Criminal Petitions, under Section 482 of Cr.P.C., are separately filed by two different Petitioners seeking to quash the orders, dated 24.10.2018, passed in Crl.M.P. Nos.318, 319 & 317 of 2018 in C.C. No.88 of 2018, by the learned Principal Junior Civil Judge, Sullurpet, Nellore District (for short, 'the trial Court'); by virtue of which the trial Court allowed the Petitions, filed under Section 451 of Cr.P.C., granting interim custody of the Lorries bearing Nos.TN-23-AX-0199 and TN-34-C-8403 and Car bearing No.TN-09-CJ-8169, imposed certain conditions, also directed the petitioners to execute a self bond of Rs.1,00,000/- with one surety for the like sum for each vehicle. 2.

Heard learned counsel for the petitioners and learned Public Prosecutor, appearing for the respondent - State.

Learned counsel for the petitioners submits that the petitioners are not in a position to pay the surety amount of Rs.1,00,000/- for obtaining interim custody of each vehicle and sought for reduction of the said amount. 4.

A perusal of the impugned orders shows that the trial Court imposed the surety amount of Rs.1,00,000/- for release of each vehicle i.e., two lorries and one car. Hence, this Court opines that imposition of the surety amount of Rs.1,00,000/- for obtaining interim custody of the vehicles being lorries and car is reasonable. Hence, no interference is required. 5.

Accordingly, with the above observation, these three Criminal Petitions are dismissed.

As a sequel, the miscellaneous petitions, if any pending, shall stand dismissed.
