THE HON'BLE SRI JUSTI CE SANJAY KUMAR CI VI L REVI SI ON PETI TI ON No.7306 of 2017 ORDER:

The grievance of the petitioner in this civil revision petition filed under Article 227 of the Constitution is with regard to the pendency of the execution proceedings initiated by her husband during his life time in E.P.No.11 of 2010 in O.P.No.19 of 1988 on the file of the learned Senior Civil Judge, Ranga Reddy District at Vikarabad, in which she has now been brought on record as his legal representative. Sri K.Amarnath Reddy, learned counsel for the petitioner, would inform this Court that the aforestated execution proceedings relate to a land acquisition which dates back to the year 1984. Though the executing Court would be under severe time constraints and tremendous work pressure, it must necessarily give priority to matters of vintage such as the subject execution petition.

It appears that the decree holder has already expired and his widow, who is herself a senior citizen of 65 yeas of age, is now prosecuting it. Litigation of this nature cannot be continued from generation to generation depriving the decree holder of the benefits of the decree. The executing Court shall therefore give priority to E.P.No.11 of 2010 in O.P.No.11 of 1988 on the file of the learned Senior Civil Judge, Ranga Reddy District at Vikarabad, and endeavour to dispose of the same expeditiously and preferably within six weeks from the date of receipt of a copy of this order.

The civil revision petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ______________ SANJAY KUMAR,J Date:09.02.2018 GJ
