SMT. JUSTICE T. RAJANI CRIMINAL PETITION No.13280 OF 2018 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the Petitioner/Appellant/Accused seeking to quash the order, dated 23.11.2018, passed in Crl.M.P. No.230 of 2018 in Criminal Appeal No.1017 of 2018, by the learned VIII Additional Sessions Judge, Ranga Reddy District (For short, 'the appellate Court'); by virtue of which, the appellate Court directed the petitioner to deposit Rs.1,00,000/- in the Court of IV Special Magistrate, L.B. Nagar at Ranga Reddy District (for short, 'the trial Court'), on or before 13.12.2018, as a condition to suspend the operation of the judgment, dated 22.10.2018, passed in C.C. No.152 of 2018 by the trial Court, till disposal of the Appeal. 2.
Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the 2nd respondent - State. 3.
Learned counsel for the petitioner submits that the petitioner is not in a position to deposit the said amount of Rs.1,00,000/- before the trial Court.

The direction given by the appellate Court directing the petitioner to deposit Rs.1,00,000/- of the compensation amount cannot be considered as exorbitant, in the light of the fact that cheque is for Rs.2,50,000/-.

Hence, the Criminal Petition is dismissed. However, time for depositing the said amount of Rs.1,00,000/- by the petitioner before the trial Court is extended by four (4) weeks from today.

As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand dismissed.
