Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
The second respondent invited applications from eligible candidates for the post of Anganwadi Worker and Anganwadi Helper for posting them at different centres in Kurnool District. The petitioner applied for the post of Anganwadi Worker/Member and she was interviewed. The certificates of the petitioner were scrutinised by the third respondent. The third respondent issued appointment order on 24.11.2017 and the petitioner was posted to Centre No.2, Chinna Hothur village, Aspari Mandal, Kurnool District. After receiving the copy of the appointment order on 24.11.2017 she went to the fourth respondent for reporting to duty on 27.11.2017, but when the fourth respondent refused to take the joining report, the present Writ Petition is filed.
The present Writ Petition is adjourned in order to enable the learned Government Pleader to get instructions and, on the basis of instructions, learned Government Pleader states that since there was a complaint against the petitioner, the petitioner was not allowed to join the post.
When the petitioner was appointed after undergoing the process of selection, she shall not be restrained from joining the post. If there is any complaint, it is always open to the authorities to conduct an enquiry with regard to the said complaint, but that cannot be a ground to prevent the petitioner from joining the post. In the circumstances, respondents 2 to 4
are directed to permit the petitioner to join the office of the fourth respondent forthwith.
The Writ Petition is, accordingly, allowed. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
