HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.42077 of 2017 ORDER:

This writ petition is filed seeking verbatim the following relief/s: '...to issue any appropriate Writ, Order or direction, preferably a Writ in the nature of Mandamus declaring the action of Respondents, especially Respondent No.2 and 4 in high handedly disconnecting the Cable Connections provided by the Petitioner to its consumers in 13 Mandals of West Godavari District, AP including Eluru Town as being illegal, arbitrary and violative of Articles 14 and 19(1)(g) of the Constitution of India by setting aside the said action and consequently direct the respondents especially Respondent Nos.2 and 4 not to interfere with the Cable connections provided by the petitioner to its consumers in 13 Mandals of West Godavari District, AP including Eluru Town, and pass such other order or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and to pass such other order or orders....'

I have heard the submissions of the learned counsel for the petitioner, of the learned standing counsel representing the 2nd respondent and of the learned standing counsel representing the 4th respondent. I have perused the material record. The submissions and grievance of the writ petitioner is that the respondents 2 & 4 are interfering with the cable connections provided by the petitioner to its customers in 13 Mandals of West Godavari District including Eluru town without following the procedure established by law and that if the cable connections, which are provided by the petitioner to its customers, are disconnected, the petitioner and its customers would suffer serious and irreparable loss.

Recording the afore-said submissions, the Writ Petition is disposed of directing the respondents not to interfere with the cable connections provided by the petitioner to its customers in 13 Mandals of West Godavari District including Eluru town; in the event, such disconnection of cable connections is necessary, the 2nd respondent Corporation shall follow the procedure established by law. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
