HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45086 of 2018 ORDER:

1) Heard both sides. With the consent of both parties, the writ petition is disposed of at the admission stage. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.3 and 4 in marking petitioner's house with Door No.42-1-137(2), Thurpukammapalem, Revenue ward No.21, situated in T.S.No.970, ward No.5, block No.13, Ongole, without issuing any notice, as arbitrary and illegal. 3) The grievance of the petitioner is that the respondents - authorities are trying to demolish or evict the petitioner from the building bearing D.No.42-1-137(2), Thurpukammapalem, Revenue ward No.21, situated in T.S.No.970, ward No.5, block No.13, Ongole, without issuing any notice and without following the procedure established by law.

4) Learned Standing Counsel for Municipality, while denying the said allegation, states that any action to be taken in removal of the building or eviction of the petitioner shall only be in accordance with law.

5) Having regard to the above, the writ petition is disposed of directing the respondents not to take any coercive steps for demolition of the said building or eviction of the petitioner from

the said premises, without issuing prior notice and following the procedure established by law.
