HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 5 0 2 2 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Station House Officer, Jawaharnagar P.S., Medchal District, dated 13.12.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the 3rd respondent Police are not interfering in civil disputes much less between the petitioner and the 4th respondent herein. The 3rd respondent Police have also not visited the petitioner's site and not directed him to stop the construction works as the said site belongs to the 4th respondent. The 3rd respondent Police have not directed the petitioner to appear before the C.I. or S.I. of Police. It is denied that the petitioner attended the Police Station on 01.11.2018 in the evening.

The allegation that the 3rd respondent is continuing harassment till the date of filing the Writ Petition is false, baseless and hereby denied. It is submitted that the 3rd respondent Police are not interfering with the property of the petitioner nor directing him to stop the construction work. It is submitted that the 4th respondent also not given any complaint against the petitioner herein, hence the question of Police visiting the petitioner's site and asking him to stop the construction work in his site does not arise.

The allegation in para 6 of the affidavit that the constables of the 3rd respondent regularly disturbing the construction work saying that the property to an extent of Ac.15.33 gts., in Sy.No.222 and Ac.0.18 gts., in Sy.No.226 does not belong to the petitioner is not correct and denied.

It is submitted that as stated above, the 3rd respondent Police are not interfering in civil disputes and not visiting the petitioner's site and not directing him to stop the construction work on his land. For the above said reasons, it is prayed that this Hon'ble Court may be pleased to dismiss the Writ Petition."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Station House Officer, Jawaharnagar P.S., Medchal District, dated 13.12.2018, with a further direction to the respondent-Police authorities not to interfere with the civil disputes unless the same is permissible in accordance with law.
