HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.42632 OF 2017 ORDER:

The petitioner challenges the proceedings dated 17-11-2017 to the extent of suspension of fair price shop authorization of the petitioner pending enquiry. Learned counsel for the petitioner submits that without indicating period of suspension, impugned order has been passed without any prior notice, the same is in violation of principles of natural justice.

On the other hand, learned Assistant Government Pleader for Civil Supplies submits that as it is only pending enquiry, no notice is required and in this case it is also stated that the petitioner has filed explanation on 27-11-2017 in pursuance to the show-cause notice-cum-suspension order dated 17-11-2017.

In view of the same, the 3rd respondent is directed to consider the explanation of the petitioner and pass orders within a period of four weeks from the date of receipt of a copy of this order after giving opportunity of hearing to the petitioner. This Court is not inclined to interfere with the order of suspension since it is pending enquiry. Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
