THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.42062 of 2017 ORDER:

This writ petition is filed seeking verbatim the following relief/s: '...to issue an appropriate writ order or direction, particularly one in the nature of Writ of Mandamus declaring the action of the respondents No.3 and 4 in trying to demolish and dispossess the petitioners from their houses being H.No.58-1-164, 58-5-53, 58-430, 58-4-24/B, 58-1-159, 58-3-145 and 58-1-141/A situated at Shivalayam Street, Kadipikonda, Kazipet, Warangal Urban District without any authority, without following the procedure as contemplated under the law as being illegal, arbitrary, unjust and in violation f Article 21 and 300-A of the Constitution of India and to pass such other order or orders....'

At the hearing, learned counsel for the petitioners would submit that the facts and issue involved in the present writ petition is squarely covered by the orders, dated 25.10.2017 and 27.11.2017, of this Court in W.P.No.35661 of 2017 and 40146 of 2017 respectively and that, therefore, this writ petition also may be disposed of by passing appropriate similar order as was passed in the afore-stated writ petitions.

Learned Standing Counsel representing the respondents 3 & 4 endorses the said submissions. She would further submit that the respondent authorities will issue notices to the petitioners in accordance with the procedure established by law before taking any action.

Recording the afore-said submissions, the Writ Petition is disposed of directing the respondents 3 & 4 not to interfere with the subject properties of the petitioners, in any manner, except after following the procedure established

by law. It is made clear that the respondents 3 & 4 are at liberty to initiate action in accordance with the procedure established by law, if they intend so to do. There shall be no order as to costs.
