ORDER:

Heard learned counsel for petitioners, learned Government Pleader for Energy, for respondent No.3, and Sri R.Vinod Reddy, learned Standing Counsel, for respondent Nos.1, 2 and 4 to 6.

The son of the 1st petitioner alleged to have died due to electrocution on 26.05.2018. The electrical pole was standing on National Highway No.44, which runs between Hyderabad and Kurnool. Claiming compensation, petitioners submitted representations to the respondent - company stating that due to negligence of the respondent - company in maintaining its equipment, the death of son of the 1st petitioner occurred, causing hardship and sufferance to the petitioners and also mental agony. Alleging inaction, the Writ Petition is filed.

Though, learned Standing Counsel sought to contend that the concerned electrical pole was erected on the National Highway and National Highways Authority of India alone is responsible for its maintenance, and the respondent - company is no way concerned, but fairly submits that, on the representations submitted by the petitioners, on various dates, no reply is furnished to them. Having regard to the same, the Writ Petition is disposed of directing the Assistant Divisional Engineer, Gadwal Division, 5th respondent herein, to examine the claim of the petitioners and furnish a suitable reply assigning reasons in support of the decision, as expeditiously as possible, preferably within four (4) weeks from the date of receipt of a copy of this order.

In consequence, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs. _____________________ P. NAVEEN RAO, J Date: 20-12-2018.
