This Writ Petition is filed seeking the following relief: "to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, to declare the action of the 2nd respondent in not considering the representation made by the petitioner and others dt.
24-10-2016 and 8-11-2017 for not to renew the licence issued in favour of the 4th respondent society and to admit the petitioner and other toddy tappers in Mittadoddi village as members in the TCS Toddy Shop, Mittadoddi, Inspite of repeated visits as being illegal, arbitrary and unjust and consequently, direct the respondent authorities to admit the petitioner and other toddy tappers of Mittadoddi village, Ghattu Mandal, Gadwal Jogulamba District as members in the 4th respondent society, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case." (Reproduced verbatim) At the hearing, the learned Counsel for the petitioner would submit that, if the petitioner's representations, dated 24-10-2016 and 08-11-2017, are considered and disposed of by respondent No.
2- Prohibition and Excise Superintendent, the ends of justice would be met and the grievance of the petitioner would be redressed.
MSRM, J W.P.No.40097 of 2017 Date: 29-11-2017 The learned Government Pleader for Excise (TS) appearing for respondent Nos.1 to 3 endorses the aforesaid submission.
The aforesaid submission is placed on record and the Writ Petition is, accordingly, disposed of directing respondent No.2 to consider and dispose of representations, dated 24-10-2016 and 08-11-2017, of the petitioner and others within four weeks from the date of receipt of a copy of this order, however, in strict accordance with the procedure established by law and after affording an opportunity of hearing to the petitioner as well as respondent No.4. After completing the said exercise and within a week thereafter, the decision taken shall be communicated to the petitioner as well as respondent No.4. As a sequel to disposal of the Writ Petition, Miscellaneous Petitions, pending if any, stand disposed of as infructuous.
