THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.13279 OF 2018 ORDER:

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused for grant of bail in Crime No.915 of 2018 of Jawaharnagar Police Station, Rachakonda District, registered for the offences punishable under Sections 307 and 302 IPC.

Heard the learned counsel for the petitioner/accused, the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

Learned counsel for the petitioner/accused would submit that the petitioner is an innocent person and falsely implicated in this case; that the petitioner/accused was remanded to judicial custody on 23.10.2018 and hence, he prays to allow the application. 4.

As per the records, the injured is an eyewitness to the incident. The allegations against the petitioner/accused are grave. The investigation is in progress. Release of petitioner, at this stage, would hinder the investigation. It can also be apprehended that the petitioner would threaten the witnesses. It is not a fit case to allow the application under Section 439 Cr.P.C at this stage. 5.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
