The petition coming on for hearing, upon perusing the Petition and the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri P Rajasekhar, Advocate for the Petitioner, and of Addl. Public Prosecutor (AP) for Respondent, the Court made the following. ORDER:
Heard learned counsel for the petitioner/A.2, learned Additional Public Prosecutor for the respondent State and perused the record.
This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner/A.2 in Crime No.188 of 2017 of Duvvada Police Station, Visakhapatnam City, for the offences punishable under Sections 302 and 448 read with Section 34 IPC.
The specific allegations against the petitioner/ A.2 is that she along with her husband A.1 and other accused went to the house of deceased G.V.Gangadhar Rao on 05.07.2017, when they were demanded to pay building maintenance amount of Rs.500/- and notices were sent to the petitioner and her husband. The petitioner along with other accused alleged to have trespassed
into the house of deceased G.V.Ganghadhar Rao and beat him and caused his death. The other accused were arrested and remanded to judicial custody. The petitioner is aged 47 years. The petitioner is a woman. The deceased-Gangadhar Rao said to have undergone bye-pass surgery, before his death. It is alleged that the petitioner has fisted deceased along with other accused.
Having regard to the nature of allegations and investigation is not commenced so far, the petitioner/A.2 can be granted bail under Section 438 Cr.P.C.
Accordingly, the Criminal Petition is allowed directing the petitioner/A.2 to surrender before the Station House Officer, Duvvada Police Station, Visakhapatnam, within 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A.2 on bail, on her executing a personal bond of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to his satisfaction. On such release, the petitioner/A.2 shall abide by the conditions mentioned under Section 438(2) Cr.P.C. Further, she shall attend before the Station House Officer concerned on every Sunday between 9.00 a.m. and 10.00 a.m. till filing charge sheet.
