HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.45070 of 2018 ORDER:

The case of the petitioners is that they have submitted applications dated 18.07.2017 before the 4th respondent under the A.P.Inams (Abolition and Conversion into Ryotwari) Act, 1956, for grant of Ryotwari pattas. They have also submitted representation to the Joint Collector, Visakhapatnam, to issue suitable instructions to the Tahsildar for grant of ryotwari pattas in their favour after conducting enquiry, in accordance with the provisions of the Inams Aholition Act. As the same are not being disposed of, present writ petition is filed.

Learned Assistant Government Pleader for Revenue produced written instructions stating that MANASAS Trust is claiming the subject lands;

that MANASAS Trust, Vizianagaram had filed Revision Petition under Section 9 of the A.P.Recordof Rights in Land and Pattadar Pass Book Act, 1971 before the Revisional Authority and Joint Collector, Visakhapatnam, stating that the subject lands and some other lands are acquired by the MANASAS Trust through the Trust Deed dated 14.11.1958 and also included in the 43 Register and prayed to cancel the manual pass books issued to the writ petitioner Nos.1, 4 and 5 herein and some other farmers; and that the said revision petition was taken on file

and numbered as RP No.47/2018 and the same is posted on 06.02.2018, with a direction to the Tahsildar, Padmanabham to submit detailed remarks and report.

Since the representation of the petitioners is pending before the 4th respondent, the 4th respondent instead of keeping the applications pending should have passed order by taking into consideration all the above aspects into consideration.

In view of the same, the writ petition is disposed of directing the 4th respondent to dispose of the representation of the petitioners dated 10.09.2018 along with applications of the petitioners dated 18.07.2017 for grant of ryotwari pattas, after issuing notice MANASAS Trust, within a period of four months from the date of receipt of a copy of this order and communicate the same to the petitioners. If petitioners are aggrieved by the said order, it is open for the petitioners to challenge the same. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 17.12.2018 tk
