HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.41918 of 2017 ORDER:

Heard Sri Rajagopallavan Tayi for petitioner and the Assistant Government Pleader for Home.

The petitioner complains inaction in registering FIR basing on the complaint dated 30.10.2017, as illegal and unconstitutional. The Assistant Government Pleader, on instructions, submits that the annexures filed along with the writ affidavit do not evidence acknowledgment of complaint, dated 30.10.2017. After perusing the material on record, this Court is of the view that the inaction cannot be entertained with the averments or annexures filed by the petitioner.

The writ petition is accordingly dismissed. The petitioner is given liberty to send copy of complaint dated 30.10.2017 to 2nd respondent by registered post with acknowledgment due and if inaction still continues, the petitioner can file fresh writ petition. No order as to costs.
