SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.41933 OF 2017 ORDER:
This Writ Petition is filed seeking to declare the action of respondents in establishing electric towers for laying of 400 KV Power Transmission Line in the house plots of the petitioners covered by Survey No.161 of Tallapally Village, Shabad Mandal, Ranga Reddy District, as illegal and arbitrary and against the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
2. At the hearing, it is represented that this Court has already considered similar issue in W.P.No.26974 of 2017, which was disposed of on 16.11.2017, wherein it is held that consent of the owner is not required. It is also represented that respondents will not proceed under the Land Acquisition Act and the petitioners are entitled to compensation under Indian Telegraph Act.
3. In view of the same, the respondents are directed to pay compensation to the petitioners in terms of the Indian Telegraph Act. If the petitioners are not satisfied with the same, they can file an application for enhancement of compensation amount under the provisions of the Indian Telegraph Act.
4. With the above directions, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J December 20, 2017 MD
