THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.42541 of 2017 ORDER :

The case of the petitioner is that he is having a rice mill and a false case was registered against him on 19.3.2017 in connection with seizure of lorry bearing registration No.AP 01X 3538 along with 270 rice bags containing petitioner rice mill name. In pursuance to the show cause notice issued to him under Section 6-A of the Essential Commodities Act 1955 in Lr.No.B/116/2017 dated 14.04.2017, he filed an explanation stating that his firm is neither connected with the seizure of the rice nor the lorry and no stock belonging to his rice mill was confiscated. Subsequently, he filed a representation dated 21.10.2017 to the third respondent to allot paddy to his rice mill under Custom Milling Rice Scheme for the Kharif season 2017-18.

His grievance is that though he is not black listed, the respondents are not considering his representation for supply of paddy under the Custom Milling Rice Scheme. On the other hand, the learned Assistant Government Pleader for Civil Supplies submits that it is for the second respondent to consider the said aspects in terms of guidelines in G.O.Ms.No.21 dated 16.10.2017 and take a decision, but the petitioner as a matter of course cannot seek for allotment of paddy for the purpose of custom milling.

In view of the above, the writ petition is disposed of keeping it open for the petitioner to place all the material before the second respondent for supply of paddy to his rice mill and the second respondent shall consider and dispose of the representation of the

petitioner dated 21.10.2017 and take action in accordance with law. No costs.

Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
