HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.12260 OF 2017 ORDER:

This Criminal Petition is filed by the petitioner/A.2 under Section 439 Cr.P.C. for grant of bail to him in Crime No.21 of 2017 of Kotananduru Police Station, East Godavari District, registered for the offence punishable under Sections 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard the learned counsel for the petitioner/A.2, learned Additional Public Prosecutor representing the respondent-State and perused the record.

During the course of submissions, it has come to light that bail application of accused No.1 was dismissed by this Court vide order dated 21.08.2017 in Criminal Petition No.6751 of 2017, wherein the learned Single Judge directed the trial court to dispose of the trial of Sessions Case vide S.C.No.98 of 2017 expeditiously, preferably, within four months from the date of receipt of copy of that order. 4.

It is brought to the notice of this Court that the schedule for Sessions Case No.98 of 2017 is only fixed, it appears that the trial is not yet commenced.

Having regard to the nature of the allegations and the material collected so far, it would be sufficient to direct the trial Court to dispose of the Sessions Case vide S.C.No.98 of 2017 within two (2) months from the date of this order.

With the above direction, the Criminal Petition is disposed of. The petitioner/A.2 is at liberty to file a bail application if the trial is not completed within the aforementioned period.
