THE HON'BLE SMT JUSTICE T. RAJANI CRIMINAL PETITION No.12724 of 2017 ORDER:

This petition is filed under Section 438 Cr.P.C. seeking for grant of anticipatory bail to the petitioner, who is A1 in Crime No.226 of 2016 on the file of the Langer House Police Station, Hyderabad City.

The offences alleged against the petitioner-A1 are under Sections 420, 468 and 471 r/w 34 IPC. 3.

Heard learned counsel for the petitioner and the learned Public Prosecutor appearing for the respondentState. 4.

The case of the prosecution is that the petitioner-A1 arranged visa to the de facto complainant, which was found to be fake when the de facto complainant approached the concerned authorities.

Learned Public Prosecutor submits that the earlier applications filed by the petitioner to grant anticipatory bail were dismissed. A perusal of the order of this Court, dated 09.09.2016 passed in Crl.P.No.13098 of 2016 shows that the dismissal order was passed on merits of the case. This Court considered that A1 and A2 handed over Visas to the de facto complainant after collecting an amount of Rs.4,00,000/- and having regard to the nature of offences, dismissed the application on merits. The dismissal was not due to anything, which can be considered, at a later point of time. When it is on merits, a fresh petition cannot be maintained, unless there is some ground which necessitated the petitioner to be on bail.

Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions, if any pending, in this petition shall stand closed.
