THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11858 OF 2017 ORDER:

Heard learned counsel for the petitioner/A.6, learned Additional Public Prosecutor for the respondent State and perused the record.

This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioner/A.6 in Crime No.54 of 2017 of Chinturu Police Station, East Godavari District, for the offence punishable under Section 8(c) read with Section 20(b)(ii)(c) of NDPS Act. The allegation against the petitioner/A.6 is that he was transporting 610 kgs of ganja in Toofan Tempo Trax bearing No. AP 01 V 0541 and Force Tempo Traveller Ambulance bearing No.TS 05 UA 4345 along with other accused. The same was seized under a cover of panchanama. The seized quantity of ganja is a commercial quantity. It cannot be said that the petitioner is innocent and falsely implicated in this case. Release of petitioner would hinder the investigation. Though the petitioner is suffering from AIDS, it is not appropriate to allow this petition. Hence, the Criminal Petition is dismissed.
