HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 5 2 1 7 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Gachibowli Police Station, Cyberabad, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that earlier the petitioner lodged a complaint on 24.03.2018 with the respondent No.3 Station House Officer, Gachibowli Police Station, Cyberabad, against his wife Penmasta Revathi and others, stating that his wife took divorced from the petitioner herein. The petitioner and his wife entered into an agreement of sale in the year December, 2016 to purchase the land under R.S.No.361-2, admeasuring Ac.9.
12 cents, situated at Antervedi village, Golndi Gram Panchayat, Sakhinetpalli Mandal, East Godavari District, and the petitioner paid amount to his vendor and also the petitioner paid Rs.9.03 lakhs to his wife for the purpose of registration charges. Further, at the instructions, his wife, the petitioner also paid Rs.35 lakhs to P.Surya Kumari for the purpose of stock market share in the name of the petitioner. But, without consent, the wife of the petitioner got registered the document of the land in favour of said P.Surya Kumari. Thus, the wife of the petitioner and said P.Surya Kumari cheated the petitioner and threatened him.
It is submitted that basing on the said complaint, a case was registered as Cr.No.250/ 2018 for the offences under Sections 420, 506 and 506 I.P.C. against i) P.Revathi and ii) P.Surya Kumar, on the file of Gachibowli Police Station, and the investigation is under progress.
It is submitted that again the petitioner herein had lodged a complaint, dated 17.11.2018, against his wife Revathi and others with regard toencroachment of his Prime Legend Apartment, Flat No.902, Botanical Garden Road, Masjid Banda, Gachibowli, Hyderabad. Pursuant to the said complaint, the respondent No.3, Station House Officer, Gachibowli Police Station, Cyberabad, enquired into the matter and revealed that the Prime Legend Apartments, Flat No.902, Botanical Garden Road, Masjid Banda, Gachibowli, Hyderabad, is registered in the name of the petitioner and his wife.
As the matter relates to civil dispute, as such the 3rd respondent suggested the petitioner to approach Civil Court for redressal. In this regard, entry was made into the General Diary and informed the same to the petitioner on 17.11.2018 and the petitioner acknowledged the same.
It is submitted that the petitioner contended that the respondent No.3 Station House Officer, Gachibowli Police Station, Cyberabad, not taken action on his complaint, dated 17.11.2018, is incorrect and baseless. As the matter relates to civil in nature, no F.I.R. was registered."
Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Gachibowli Town Police Station, Cyberabad. However, it is open for the petitioner herein to avail the remedies, in accordance with law.
