HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.45325 of 2018 ORDER:

This writ petition is filed stating that respondentauthorities are not taking action on the illegal construction made by respondents 6 and 7 in Sy.No.544, Lalgadi, Malakpet, Shameerpet and encroaching the public road and causing obstruction to the free flow of the traffic, inspite of the representation made by the petitioners.

Sri G.Narender Reddy, learned Standing Counsel for respondent No.5 on instructions submits that there is no public road as alleged by the petitioners. The unofficial respondents are making constructions in their private lands. But the same is disputed by learned counsel for the petitioners. The petitioners have not filed any village map showing existence of public road in support of their contention.

In view of the same, this Court cannot go into disputed questions of fact in the writ petition. However, it is open for the petitioners to avail civil law remedies, if still aggrieved by the same.

Accordingly, the writ petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. ___________________________ A.RAJASHEKER REDDY,J 21-12-2018 Nvl
