HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.7427 of 2018 ORDER:

Aggrieved by the rejection of an application for summoning the records relating to Patta Passbook proceedings, the plaintiff in a suit for injunction has come up with the above revision.

2. Heard Mr. B. Bala Murali Krishna, learned counsel for the petitioner.

3. The suit is only for injunction. There is also a counter claim for injunction. A patta is relied upon by the respondents. The records of the proceedings of the Tahsildar, even if they are summoned, at the most would indicate whether proper procedure was followed before granting of patta. Assuming that proper procedure was not followed, it would not vitiate the patta, unless it is set aside under the provisions of the Andhra Pradesh Rights in Lands and Pattadar Pass Books Act, 1971. Therefore, the dismissal of the application by the trial Court was perfectly in order. Hence, the Civil Revision Petition is dismissed.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
