HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.41256 OF 2017 ORDER: (Oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner seeks direction thereby directing the respondents to produce the petitioner's daughter Sai Harshitha, aged 12 years before this Court and set her at liberty.

2. Pursuant to order dated 13.12.2017, respondent No.4 is personally present in Court with minor child named above. This Court has interacted with the child and she states that she is comfortable with his grand father i.e., respondent No.4, and at this stage, she does not want to go with petitioner/mother.

3. In addition to above, learned counsel for the respondent No.4 states that the father of the child died on 02.02.2006, thereafter the petitioner has remarried with another man in the year 2009, and since 2010, the minor child named above, is staying with respondent No.4.

4. If the petitioner wants custody of the child, she is at liberty to file proper petition before the appropriate forum.

5. In view of the above, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending shall stand closed.
