HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Writ Petition No.45154 of 2018 Order: (per V.Ramasubramanian, J.) Challenging the proposed auction of his property for nonpayment of the dues, a dealer under the Andhra Pradesh Value Added Tax Act, 2005, has come up with the above writ petition.

2. Heard Mr. Shaik Muneer Basha, learned counsel for the petitioner. Mr. Shaik Jeelani Basha, learned Special Standing Counsel, takes notice for the respondents.

3. The amount of tax and penalty due is Rs.3,04,460/-. The petitioner is prepared to pay the same in instalments.

4. Section 22(6) of the A.P. VAT Act, 2005, enables the petitioner to make a representation to the Deputy Commissioner for extending the facility of payment by instalments. Therefore, the writ petition is disposed of permitting the petitioner to file an application before the competent authority under Section 22(6) within one week from the date of receipt of a copy of this order. Within two weeks thereafter, the Deputy Commissioner shall pass orders on the said representation in accordance with law. Pending applications, if any, shall stand closed. No costs.
